Policy on Digital Millennium Copyright Act, Notice and Action Steps

UMR GmbH is comitted to promptly addressing valid claims of copyright infringement that align with the provisions of the United States Digital Millennium Copyright Act (DMCA). You can find the complete text of the DMCA at the U.S. Copyright Office Website, http://www.copyright.gov

All users of LiveTheFuture.co are anticipated to adhere to the copyright laws in force. In the event of receiving a valid claim of copyright infringement, our actions will encompass removing or disabling access to the said infringing material and/or ceasing collaboration with contributors, irrespective of our liability under U.S. laws or other international legislations.

Should we disable or remove access due to such a notice, we'll proactively try to reach out to the conten's creator, allowing them to submit a counter-notification as per Sections 512(g)(2) and (3) of the DMCA. We also retain the right to keep records of any such infringement claims we act upon.

  1. Your details, encompassing your name, postal address, phone number, and, if accessible, an email address where we can reach out to you;
  2. Statement: “I am the copyright holder, or an agent with the authority to represent the owner, of the following copyrighted content:”;
  3. Explicitly identify the copyrighted content you believe has been violated. For instance, “The content in question is the “Content Title”, which is “Description: literary piece, image, etc.” by “author's name”, including any official registration details, if available;
  4. Point out the material you believe is infringing, providing information that lets LiveTheFuture.co locate it (e.g., “Article Title” located at: https://www.livethefuture.co/link-to-article/);
  5. Statement: “I am of the conviction, in good faith, that the said material's use as complained about is not sanctioned by the copyright owner, its agent, or the law”;
  6. Declaration: “I solemnly affirm, risking perjury penalties, that the details in this notification are accurate”;
  7. Affix your signature to the document.

Response to Alleged Infringement Notice

The individual or entity that provided the content in question can issue a response in line with sections 512(g)(2) and (3) of the Digital Millennium Copyright Act.

To submit such a response to UMR GmbH, you are required to provide a written communication (preferably via regular mail) that elaborates on the items listed below. Unless there's an existing written agreement, refrain from sending the below-mentioned information through email. It's worth noting that if you falsely claim that an activity or product isn't in violation of another's copyrights, you might be held accountable for damages (this could include legal fees). Hence, if you're uncertain about whether specific content breaches another's copyrights, reaching out to a lawyer is advised.

For efficient handling of your response, kindly adhere to the subsequent format (inclusive of section numbers):

  1. Pinpoint the content that was either removed or had its access revoked, along with the original location of said content before its removal or access denial.
  2. Your personal details: name, address, phone number, and, if feasible, an email address where you can be reached.
  3. Declaration: “I submit to the authority of the Federal District Court of the [input the federal judicial district linked to your address]”;
  4. Statement: “I will acknowledge the service of legal documents from [state the name of the person who initiated the original infringement claim] or their authorized representative”;
  5. Declaration: “I solemnly affirm, risking penalties for perjury, that my belief is genuine in thinking that the content in question was taken down or had its access revoked due to an error or a misjudgment regarding its identity”; and
  6. Affix your signature to the document.
  7. Forward the detailed communication (via email, fax, or postal mail) to our dedicated Copyright Representative for DMCA notifications:

Upon obtaining such a response, LiveTheFuture.co will immediately share a copy of this response with the individual who submitted the initial claim of copyright infringement, and notify them that LiveTheFuture.co intends to restore the disputed content or halt its access restrictions within 10 business days. LiveTheFuture.co will restore the content or stop its access restrictions between 10 to 14 business days post-receiving the response, unless our appointed Copyright Representative is informed by the initial complainant of a legal motion filed in a court, aiming to prevent the account holder from participating in activities that may infringe upon the content on our platform or network.

Multiple Infringements

In line with Section 512(i)(1)(A) of the DMCA, LiveTheFuture.co will take the necessary steps, under suitable circumstances, to restrict and/or close the accounts of users who repeatedly violate copyrights.
